Terms & Conditions — Gary Wallage Photography

Version 4.0 — September 2026 These Terms and Conditions govern all bookings made with Gary Wallage Photography (trading as Photos to Treasure), operated by Gary David Wallage, of 63 Twinehame Road, Swindon SN25 2AG (“the Photographer”). By confirming a booking, paying any sum toward a session, or signing a Booking Confirmation, you (the “Client”) agree to be bound by these Terms. Please read them carefully.

1. Definitions

1.1 “Session” means the photography session(s), consultation, and any pre-shoot coverage described in the Booking Confirmation. 1.2 “Images” means all photographs produced during the Session. 1.3 “Gallery” means the private online gallery through which Images are delivered. 1.4 “Booking Confirmation” means the written confirmation of the date, service, and pricing issued by the Photographer.

2. Booking & Consultation

2.1 Pre-shoot consultations are complimentary and carry no obligation to book. They allow full discussion and customisation of your session before any commitment is made. 2.2 A booking is confirmed once a Booking Confirmation has been issued and any payment due at that stage (see Clause 3) has been received. Dates are not held on the strength of an enquiry alone. 2.3 The Booking Confirmation, together with these Terms, forms the entire agreement between the parties for that Session. Any changes must be agreed in writing.

3. Payment

3.1 For most sessions, a non-refundable deposit of 25% of the total fee is due at the time of booking to secure the date, with the balance due no later than 14 days before the Session (or in full at booking for sessions under £300). 3.2 Wedding bookings follow a different, more relaxed schedule, reflecting the fact that most couples book well in advance: the date is held free of charge with no deposit; a payment of 10% of the total package fee becomes due when the coaching / save-the-date shoot is booked; a further 50% is due six months before the wedding date; and the final balance is due 14 days before the wedding. Where a wedding is booked less than six months before the date itself, these payments are collected on a compressed timetable at the Photographer’s discretion, agreed in writing at booking. 3.3 Payment may be made by bank transfer, card payment, or any other method the Photographer makes available. 3.4 Late payment of a balance may, at the Photographer’s discretion, result in the date being released.

4. Rescheduling & Cancellation

4.1 We understand plans change. Non-wedding sessions may be rescheduled with at least 48 hours’ notice at no penalty, subject to availability. 4.2 Wedding sessions may be rescheduled once free of charge with at least 30 days’ notice; any sums already paid transfer to the new date. Rescheduling requests inside 30 days are treated as a cancellation under 4.3–4.4. 4.3 Cancellations must be notified in writing (email is acceptable). Deposits and any wedding payments already made under Clause 3.2 are non-refundable, as they compensate the Photographer for holding the date exclusively and turning away other enquiries. 4.4 For wedding cancellations: notice of 60 days or more before the wedding forfeits sums already paid with nothing further owed; notice of 30–60 days requires payment up to 50% of the total package fee; notice of under 30 days requires payment of the full package fee. Clients are encouraged to consider wedding insurance to cover these circumstances.

5. Cancellation or Postponement by the Photographer

5.1 In the very unlikely event the Photographer cannot attend due to serious illness, emergency, or death, every reasonable effort will be made to arrange an equivalent replacement photographer from a trusted network. 5.2 Where no suitable replacement can be arranged, the Client receives a full refund of all sums paid. This is the Photographer’s total liability in such circumstances. 5.3 Force majeure (extreme weather, civil emergency, and similar events beyond reasonable control) is handled the same way: both parties work in good faith to reschedule, with payments transferring to the new date.

6. Copyright & Use of Images

6.1 All Images remain the copyright of the Photographer under the Copyright, Designs and Patents Act 1988. 6.2 The Client receives a personal, non-exclusive licence to print, display, and share their Images for non-commercial personal use, in perpetuity. Sharing on personal social media is welcomed, with a photo credit to Gary Wallage Photography appreciated where practical. 6.3 Unless the Client objects, the Photographer may use a selection of Images in their portfolio, website, and social media, on the basis of the Photographer’s legitimate business interest in showcasing their work. The Client may object to this at any time, before or after the Session, by writing to photographer@garywallage.uk; the Photographer will stop using the Client’s Images for this purpose going forward, though material already published may not always be retractable. Published pricing reflects that portfolio and marketing use is included as standard. 6.4 This does not apply to boudoir and other intimate photography sessions, where no Images will be used for marketing or portfolio purposes without the Client’s separate, explicit written consent — this remains an absolute, opt-in-only policy with no exceptions. 6.5 Images may not be sold, sub-licensed, or commercially exploited by the Client without prior written agreement.

7. Delivery

7.1 High-resolution, fully edited digital images are delivered via a private online gallery within the timeframe agreed at booking. For weddings this is typically within 6 weeks (extending to 8 weeks in peak season, May–September), and Clients will be told in advance if this applies. 7.2 Galleries remain accessible for 12 months from delivery as standard (24 months for weddings). Clients are responsible for downloading and backing up their Images within this period. 7.3 Unedited (“raw”) files are not supplied as standard; requests are considered case by case and may attract an additional fee.

8. Liability

8.1 The Photographer’s total liability for any claim arising from a Session is limited to the total fees paid for that Session. 8.2 The Photographer is not liable for indirect or consequential loss, or for loss or damage to personal items brought to a session. 8.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or anything that cannot lawfully be excluded.

9. Client Responsibilities

9.1 The Client is responsible for ensuring anyone photographed has consented to being photographed and to the uses described in Clause 6. 9.2 The Client is responsible for checking that any chosen venue permits professional photography and for communicating any restrictions in advance.

10. Complaints

10.1 Any complaint about the Images or service should be raised in writing within 30 days of gallery delivery. We aim to respond within 5 business days and to resolve concerns in good faith.

11. Governing Law

11.1 These Terms are governed by the laws of England and Wales, and any disputes fall under the exclusive jurisdiction of the courts of England and Wales.
